Participants of Rakshak Foundation’s Summer Research Program

Rakshak Foundation does not provide liability insurance for the protection of individuals, groups, organizations, businesses or others who may participate in Rakshak Foundation’s Summer Research Program (referred to as Summer Research Program throughout this document).

In consideration for your participation in Summer Research Program, the individual, group, organization, business, spectator, or other, does hereby release and forever discharge Rakshak Foundation as well as Rakshak Foundation NGO and its officers, board, mentors and employees, jointly and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by participating in the Summer Research Program.

This release extends and applies to, and also covers and includes, all unknown, unforeseen, unanticipated and unsuspected injuries, fatality, damages, loss and liability and the consequences thereof, as well as those now disclosed and known to exist. The provisions of any state, federal, local or territorial law or state providing substance that releases shall not extend to claims, demands, any damage (financial, physical or otherwise), loss or injuries, or damages which are known or unsuspected to exist at this time, which hereafter may be sustained by participating in the Summer Research Program to the person executing such release, are hereby expressly waived.

It is further understood and agreed that said participation in Summer Research Program is not to be construed as an admission of any liability and acceptance of assumption of responsibility by Rakshak Foundation, Rakshak Foundation NGO its officers, board, mentors and employees, jointly and severally, for any damages and expenses for which Rakshak Foundation, Rakshak Foundation NGO, its officers, board, mentors and employees, become liable as a result of any alleged act of the participant.




Confidentiality Agreement

CONFIDENTIALITY AGREEMENT


This Confidentiality Agreement (“Agreement”) is entered into by and between Rakshak Foundation and the intern (electronically signed by the intern, when submitting the form)

1. “Confidential Information.” For purposes of this Agreement, Confidential Information shall mean all the data; information, contact information of mentors and/or co-interns, project records, strategic and development plans; business plans; policies, and procedures; project presentations; all templates of reports and presentations; and all other information made available to the intern.

2. Non-Disclosure Obligations. Intern promises and agrees to receive and hold the Confidential Information in confidence. Without limiting the generality of the foregoing, Intern further promises and agrees:

• To protect and safeguard the Confidential Information against unauthorized use, publication, or disclosure.

• Not to use any of the Confidential Information except for the academic purposes and that too with citation and acknowledgement of the Rakshak Foundation.

• Not to — directly or indirectly — in any way, reveal, report, publish, disclose, transfer physically or electronically or otherwise use any of the Confidential Information without any written authorized consent by the Organization in accordance with this Confidentiality Agreement.

• Not to use any Confidential Information to unfairly compete or obtain an unfair advantage against the Organization in any commercial activity, which may be comparable to the commercial activity contemplated by the parties in connection with the business purposes.

• To advise each of the persons to whom Intern provides access to any of the Confidential Information complying with this aforementioned clauses, that such persons are strictly prohibited from making any use, publishing or otherwise disclosing to others, or permitting others to use for their benefit or to the detriment of the Organization, any of the Confidential Information, and, upon request of the Organization, to provide the Organization with a copy of a written agreement to that effect signed by such persons.

• To comply with any other reasonable security measures and terms requested in writing, by the Organization.

3. Exceptions. The confidentiality obligations hereunder shall not apply to Confidential Information which: is, or later becomes, public knowledge other than by a breach of the provisions of this Agreement; is in the possession of the Intern, as evidenced by written records; or is independently received by the Intern from a third party, with no restrictions on disclosure.

4. Return of Confidential Information. The Intern agrees, upon termination of the relationship or upon the written request of the Organization, whichever is earlier, to promptly deliver to the Organization all records, notes, and other written, printed, or tangible materials in the possession of the individual, pertaining to the Confidential Information.
